This Privacy Policy explains how MadPixel Software Inc., a company incorporated in Canada, collects, uses, and shares personal information when you visit madpixel.software or download, install, or use the madphase desktop application.
1. who we are
MadPixel Software Inc. is the controller of the personal information described in this policy. The madpixel website and madphase software are referred to together as the services. If you have questions or wish to exercise your rights, contact us at [email protected].
2. summary
- madphase processes your images, video, and project files locally on your device.
- We do not require you to upload creative content to us to use the core features, and we do not collect or store that content on our servers as part of normal use.
- On the website, we collect information you give us, such as your waitlist email address, and limited technical data from our hosting provider.
- In the software, we collect limited diagnostic and crash-report information to fix bugs and improve stability.
- We use trusted service providers, including Sentry for error reporting, Cloudflare for hosting and infrastructure, Paddle for payments, and an email or marketing provider if needed for waitlist and product emails.
3. information we collect
information you provide
- Waitlist and subscription details. When you join the waitlist or sign up for updates, we collect your email address and any other information you choose to provide.
- Communications. When you contact us, we collect your message and contact details.
- Purchase information. If you buy a license or subscription, Paddle collects the information needed to process your payment. We receive confirmation of the transaction and limited details, such as your email, country, and order reference, but we do not receive or store full payment-card numbers.
information collected automatically
- Website technical data. Cloudflare automatically processes technical information when you visit the website, such as your IP address, browser type, device and operating-system information, referring pages, and timestamps. This is used for security, performance, and site operation.
- Crash and diagnostic data. The software uses Sentry to capture crash reports and error diagnostics. Crash reports may include the error type and message, stack trace, app version, operating system, device type, and limited technical context about the state of the application at the time of the error.
- License and update checks. The software may contact our systems to validate a license and check for updates, which involves limited technical information such as the app version and operating system.
information we do not collect
We do not collect or store the images, video, audio, or project files, including
.mphase files, that you create or edit in the software as part of normal use.
These remain on your device unless you choose to use an optional feature that sends data to a
third party.
4. how we use information
- Operate and maintain the website and waitlist.
- Send product updates, availability announcements, and marketing emails where you have signed up or otherwise consented.
- Provide, support, and improve the software, including diagnosing crashes and fixing bugs.
- Process purchases, validate licenses, and deliver updates.
- Secure the services and detect, prevent, and respond to fraud, abuse, or technical issues.
- Respond to inquiries and comply with legal obligations.
5. legal bases for processing
Where the GDPR or similar laws apply, we rely on consent for marketing emails and waitlist signup, contract to provide the software and process purchases, legitimate interests to secure and improve the services, and legal obligation where we must process information to comply with the law.
6. email and marketing communications
If you join the waitlist or subscribe, we may use an email or marketing provider to send messages about madpixel and madphase. Every marketing email includes an unsubscribe link, and you can opt out at any time by clicking it or emailing [email protected]. We may still send essential service or transactional messages, such as purchase confirmations or important service changes, where permitted by law.
7. cookies and analytics
The website may use strictly necessary cookies or similar technologies required to operate and secure the site. We do not sell advertising profiles or use third-party advertising trackers. If we add analytics or non-essential cookies, we will describe them and, where required, request your consent.
8. optional third-party and ai features
The software may offer optional features that connect to third-party services. Where a feature uses your own third-party API keys, the data and prompts you submit are sent directly to the provider you configured, under that provider's terms and privacy policy, not to MadPixel. You control whether to use these features and which provider to use.
9. how we share information
We do not sell your personal information. We share it only as follows:
- Sentry for crash and error reporting and diagnostics.
- Cloudflare for website hosting, content delivery, security, and infrastructure, including Workers, D1, KV, and R2 used to run the website and waitlist.
- Email or marketing providers for sending waitlist and marketing emails, if used.
- Paddle for processing purchases.
- Legal and safety recipients where required to comply with law, enforce our terms, or protect the rights, property, or safety of MadPixel, users, or others.
- Business-transfer recipients in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.
These providers are authorized to use your information only as necessary to provide services to us.
10. international data transfers
MadPixel is based in Canada, and our service providers may process information in Canada, the United States, the European Union, or other countries. Where personal information is transferred across borders, we take steps to ensure it receives an adequate level of protection as required by applicable law.
11. data retention
- Waitlist and marketing data is kept until you unsubscribe or ask us to delete it, after which we may retain a minimal suppression record so we do not contact you again.
- Crash and diagnostic data is retained for a limited period sufficient to diagnose and fix issues, then deleted or aggregated.
- Purchase and transaction records are retained as required for tax, accounting, and legal purposes.
12. security
We use reasonable technical and organizational measures to protect personal information against unauthorized access, loss, or misuse. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding any credentials and keeping backups of your content.
13. your rights
Depending on where you live, you may have rights to access, correct, delete, object to or restrict processing of, withdraw consent for, or request a portable copy of your personal information. You may also have the right to lodge a complaint with a privacy authority.
- Canada. You may request access to and correction of your personal information, and may complain to the Office of the Privacy Commissioner of Canada.
- EEA / UK. You may exercise GDPR rights and complain to your local data-protection authority.
- California. You may request access, deletion, and correction, and may opt out of sale or sharing of personal information. We do not sell your personal information.
To exercise any right, email [email protected]. We will respond within the timeframe required by applicable law and may need to verify your identity first.
14. children's privacy
The services are not directed to children, and we do not knowingly collect personal information from children under the age of majority or digital consent in their jurisdiction. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.
15. changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date and, for material changes, provide additional notice where appropriate. Your continued use of the services after changes take effect constitutes acceptance of the revised policy.
